I.      CALL TO ORDER - 8:00 p.m.

        Chairman Philip Lindquist advised all present that the meeting was being tape recorded and reviewed the agenda for the public hearing. He asked if all abutters had been properly notified and was advised by Administrative Assistant Barbara Ferguson that certified mail receipts for all abutters had been received by the Planning Board office.  Vice Chairman Gerard LeBlanc read the following public hearing notice published in The Hanson Express on February 12 & 19, 2004.

PUBLIC HEARING NOTICE


        The Hanson Planning Board will hold a public hearing on Wednesday, March 3, 2004 at 8:00 p.m. in the Hanson Town Hall, 542 Liberty Street, Hanson, MA on a definitive subdivision plan showing a 6-lot residential subdivision off Whitman Street.  The plan is further identified as Lot 18A-4 on Assessors’ Map 102.  Deed to said property is recorded in Plymouth District Registry of Deeds, Book 25332, Page 2. The  subdivision plan, entitled Deer Hill, is located in Hanson and dated January 21, 2004 by John Cavanaro Consulting, 179 Chief Justice Cushing  Highway, Cohasset, MA 02025. The plan was submitted by South Scituate Building and Development, Inc., P. O. Box 5123, Norwell, MA 02061.  A copy of the subdivision plan is available in the Hanson Town Clerk’s Office and in the Planning Board office for review.

II.     Presentation of plans from applicant/engineer

       Brendan Sullivan of John Cavanaro Consulting of Cohasset told the Board he had discovered that surveying errors were made in the subdivision plan approved by the Board in 1966.  He said he would be requesting a rescission of the 1966 plan and filing a correction plan. There were 11 lots on the 1966 plan, he said.  The front four lots have been sold off. He said he would try to hold the existing frontages on Whitman Street. The new plan has six lots that meet the current zoning requirements. The existing house and pool, located within the confines of the current subdivision plan, he said, will be torn down. He noted that an order of conditions has already been obtained from the Conservation Commission and that two percolation tests have been done on each lot.

        He said that the plans show a detention basin at the cul-de-sac at the end of the 670 foot dead end road that will take most of the drainage.  The rest will drain down to Whitman Street.  The flow to Whitman Street, he said, will be less than existing conditions. The bottom of the basin is 1,400 square feet, he said.  It will be 3,000 square feet at the end of a 100 year storm. It will ultimately discharge into the wetlands to the rear of the property.

        Mr. Sullivan reviewed the six waivers that are being requested as indicated on Sheet No. 1 of the plan. They include a reverse curve, a reduction in the street sideline rounding, a street grade of five percent, a dead end street in excess of 500 feet, a reduction in the distance from the roadway line to drain outlets, and a bituminous concrete curb at a finished street grade greater than 6 percent. An additional waiver request based on the comments from the Board’s review engineer, Land Planning, Inc. of Hanson, he said, would be from the requirement for 3.5 feet of cover for drain pipes.  

        Mr. Sullivan said that a meeting has been scheduled for March 10, 2004 with Steven Wry of Land Planning, Inc. to review the comments contained in his eight-page March 2, 2004 review letter to the Board.

        Raymond & Cynthia Fish - Cynthia Fish told the Board that drainage problems had escalated over the 28 years she and her husband had owned their property. Everything that has been constructed, she said, is uphill from her house and when it rains she gets water in her yard, garage and cellar.  The situation has on occasion been so bad, she said, that she has had to call the Fire Department. She said that she foresees even more problems with the construction of new homes.

        Brian & Karen Downey - Brian Downey asked whether the description of his deed will change because of the mathematical errors that occurred with the original subdivision and was told that it will.  He commented on the problems that are created by the water that currently drains out on to Whitman Street and was told by Mr. Sullivan that there would be less water with the drainage system than is planned for the new development.

        Michael & Beth Richardson - Michael Richardson also testified to the problems that currently exist with water sheeting over Whitman Street when it rains.

        Charles & Barbara Soul - Charles Soule said that some of his water problems abated when Route 58 was redesigned.  But, he said, the road still becomes very icy in the winter.

        Lawrence & Margaret Mishou - Margaret Mishou said that her side yard is a mess from the water problems on Whitman Street.

        Brian & Linnea Milligan - Brian Milligan also expressed concern about the water problem on Whitman Street.  He said it is so bad he has had to cement up windows to keep the water out.

V.      Questions/Comments from other Town Boards/Departments

        A.      Police Department

        No response was received to the Board’s February 9, 2004 memo seeking input.

        B.      Water Department
        
        Chairman Lindquist read a February 19, 2004 memorandum from Water Superintendent Glen Doherty indicating that the layout of the water mains and water service lines to the lots look okay but noting that the developer will have to install new eight inch valves on the main to serve this project.

        C.      Fire Department

        Chairman Lindquist read a March 1, 2004 memorandum from Fire Chief Allen Hoyt indicating that the turning radii of the cul-de-sac does not appear sufficient to allow the department apparatus to maneuver and that the requirement of a maximum of 300 feet between hydrants in residential areas has not been met.

        D.      Board of Health

        Chairman Lindquist read a March 3, 2004 memorandum from the Board of Health office indicating that four lots passed percolation tests in November 2003 and two lots failed. The results are on file in the Board of Health office.

        E.      Building Inspector

        Chairman Lindquist read a March 2, 2004 letter from Building Inspector Michael Kennedy recommending that no fences, hedges, or signage be set within 20 feet of Whitman Street.  All lots, Mr. Kennedy said, meet the criteria of the town’s zoning ordinance.

        G.      Conservation Commission

        Chairman Lindquist read a March 2, 2004 memorandum from Conservation Agent Tricia Cassady indicating that the Commission has issued a local Order of Conditions for the work at Deer Hill because the only wetland resource area on the site was an isolated wetland.
        
        H.      Highway Surveyor

        Chairman Lindquist read a March 2, 2004 letter from Highway Surveyor Richard Harris expressing concerns with the proposed drainage for Deer Hill as it is located in one of the wettest areas in town.  He recommended the installation of sub-drains to absorb subsurface water and a cross drain grated across the entire intersection to eliminate the possibility of run off to sheet or flow across Whitman Street. He said that the proposed drains should not be connected to the street drainage system and the driveway locations should be actual locations to coincide with the drainage as presently shown on the plan.

VI.     Questions from Planning Board Members

        Gerard LeBlanc said he had many concerns with the application. He questioned how the applicant could be requesting waivers on a plan he intended to rescind.  He said there were too many issues to address them at the present time.

        Gordon Coyle said that he was concerned with the water problems called to the Board’s attention by the abutters.

        Joan DiLillo said that she was concerned with the drainage.  She said that she favored granite curbing,  She said that she had safety concerns for vehicles entering on to Whtiman Street. She also favored a buffer of trees for the privacy of abutters.

        David Nagle asked if the Board’s engineer had addressed the drainage issue.  He said that another look should be taken at the proposed drainage in light of the comments from abutters.

        
VII.    Comments from Board’s Engineer, Land Planning, Inc.

        Due to the length of the March 2, 2004 letter from Land Planning, Inc. and the information that a meeting was scheduled for the following week between Land Planning and John Cavanaro Consulting, there were no comments read.
